The rules are set out plainly by the government on the GOV.UK tenancy deposit protection pages, and the headline is that your money belongs to you until the landlord can show a reason to keep some of it.

Cleaning is one of the most common reasons they try. It is also one of the most disputed, because the line between a genuine cleaning charge and ordinary wear is not always obvious. The principle, set out by Citizens Advice, is that a landlord cannot deduct for fair wear and tear, only for the property being left worse than the check-in condition allowing for normal use. Spelthorne Borough Council is the authority for Ashford, and its position on shared houses is worth knowing if you rent a room or let one out. The council runs mandatory HMO licensing only. There is no additional or selective licensing scheme covering the borough, which is the case across a good few Surrey districts. Mandatory licensing means a house in multiple occupation must be licensed where it is let to five or more people forming more than one household, the threshold set out on the GOV.UK HMO licence guidance and grounded in Part 2 of the Housing Act 2004.

There is one recent change worth flagging, because it caught a lot of local landlords out. From 13 March 2026 a borough-wide Article 4 Direction came into effect across Spelthorne. That is a planning control, separate from licensing: it removes the permitted development right that previously let a family home be converted into a small HMO for up to six people without planning permission. Now you need planning consent to create a small HMO of three or more unrelated occupants anywhere in the borough. So in Ashford you can have a perfectly legal three-person shared house that needs no licence but does, if it was converted after that date, need planning permission.

Why does this matter at checkout? Because shared houses are inspected harder than family lets. More tenants means more wear, more cooking on one oven, and more pressure on shared bathrooms, so the clerk’s bar for a clean pass is effectively higher.
